The American Civil Rights Project supports the 20 industry petitioners arguing that the 8th U.S. Circuit Appeals Court should vacate the FCC’s digital discrimination broadband rule since it runs afoul of the law and isn’t based on clear congressional intent (see 2404230032), according to the nonprofit’s amicus brief. It was filed Wednesday in docket 24-1179.
Vermont’s net neutrality law seems in good shape legally following two significant, late-April decisions by the FCC and the 2nd U.S. Circuit Court of Appeals, said experts on the statute. ISP groups must decide what to do with their 2018 lawsuit at U.S. District Court of Vermont now that the case can resume following the 2nd Circuit ruling.
The FCC should rein in its Enforcement Bureau to avoid conflicts with recent and expected U.S. Supreme Court decisions, though the current bureau doesn’t “overreach” as frequently as it did under former Chairman Tom Wheeler, FCC Commissioner Brendan Carr said Thursday during a Wiley panel discussion called “Opportunities to Reform FCC Enforcement." Carr told us, “The jury is still out” on whether the EB under FCC Chairwoman Jessica Rosenworcel needs reform, he said in an interview after the panel discussion: “We’re not off the rails the way the agency was during the Wheeler tenure."
Top Affordable Connectivity Program Extension Act (HR-6929/S-3565) backers Sens. J.D. Vance, R-Ohio, and Peter Welch, D-Vt., said Thursday they plan to press forward with an amendment to the bipartisan 2024 FAA Reauthorization Act that would appropriate $7 billion in stopgap funding for the ailing FCC broadband program (see 2405010055) despite opposition from Senate leaders. ACP stopgap funding advocates used a Senate Communications Subcommittee hearing that day to implore that Congress act while critics raised objections about what they said was a lack of clear information about the program's efficacy.
Charter Communications sought New Hampshire conditions on Consolidated Communications' transfer of indirect ownership and control of its local subsidiaries to Condor Holdings, a subsidiary of private equity firm Searchlight. Charter didn’t oppose the deal but asked the New Hampshire Public Utilities Commission for conditions related to wholesale intercarrier relationships. Statements from Consolidated and Condor about maintaining the status quo "are ultimately meaningless unless there is a specific minimum period of time that ensures the continuity of existing wholesale intercarrier relationships,” said Michael Scanlon, Charter vice president-circuit operations, in written testimony Friday (docket DT 23-103). First, the PUC should require that Consolidated "honor existing interconnection agreements and their terms, including those of any tariffs or pricing guides" for three years after the deal closes, the Charter official said. Second, force Consolidated to process "number ports so as to meet or exceed [PUC] and FCC porting requirements with at least the same level of quality and intervals as they did pre-Transaction,” he said. Third, require that the company use existing operations support and billing support systems for at least 36 months after the deal closes. "It should also maintain at least the same intervals, quality of service, accuracy, and flow-through,” Scanlon wrote. Additionally, still under the third proposed condition, Consolidated should agree that, before migrating away from any existing systems related to wholesale, it should file a plan for the state commission to seek comment on, then approve, delay or deny. If approved, the company should provide CLECs with training on the new system, the Charter official said. If the migration results in “significant negative impacts to wholesale providers occur due to the migration, CLECs should be able to seek Commission approval of payment by Petitioners of all documented costs directly related to the migration." Under a fourth proposed condition, the PUC should require the company to "sufficiently staff its wholesale customer support centers with adequately trained personnel dedicated exclusively to wholesale operations; maintain updated escalation procedures, contact lists, and account manager information; and assign a single point of contact to [Charter New Hampshire] to address interconnection agreements, systems, and other issues,” said Scanlon: And the company should agree not to recover any transaction or rebranding costs through wholesale rates.
Some California lawmakers want to take broadband responsibilities from the California Public Utilities Commission and create a broadband office, similar to many other states. At a webcast hearing Wednesday, the Assembly Communications Committee advanced Democratic Chair Tasha Boerner’s AB-2575, which would establish a department and commission on broadband and digital equity. The committee also cleared bills concerning the 211 helpline, video franchising and shot clocks for utilities to review broadband applications.
The Senate Commerce Committee confirmed Thursday the panel plans to mark up the draft Spectrum and National Security Act and five other tech and telecom-focused bills during a Wednesday executive session, as expected (see 2404240074). The 108-page draft measure from committee Chair Maria Cantwell, D-Wash., would restore the FCC’s spectrum auction authority through Sept. 30, 2029, also as expected (see 2403210063). The proposal also provides a new vehicle for allocating stopgap funding for the commission’s ailing affordable connectivity program amid a delay in advancing a separate House-side bid to force a floor vote on providing that money, lobbyists told us.
While the "all-in" video pricing order has appeared in the Federal Register and is now effective (see 2404180008), compliance will be phased in, the FCC Media Bureau said in a public notice in Tuesday's Daily Digest. It said compliance for mid-sized and large cable and direct broadcast satellite operators won't be required until either Dec. 19 or when the Office of Management and Budget completes its Paperwork Reduction Act review, whichever comes later. Compliance for cable operators with annual receipts of $47 million or less won't be required until March 19, 2025, or Paperwork Reduction Act review, whichever comes later.

California state and local enforcers could seek injunctive relief for digital discrimination under modification to a bill by Assemblymember Mia Bonta (D). The Assembly Judiciary Committee approved AB-2239 with the amendment at a livestreamed meeting Tuesday. The panel and the Senate Judiciary Committee also considered multiple bills on algorithms and social media.
