E-Commerce Group Meets With Carr Aide on Quiet-Hour Concerns

Representatives of the Ecommerce Innovation Alliance met with an aide to Chairman Brendan Carr on the group’s pursuit of a declaratory ruling finding that people who provide prior express written consent to receive text messages can't claim damages under the Telephone Consumer Protection Act for those received outside the hours of 8 a.m. to 9 p.m. (see 2503030036).

“Cases are continuing to be filed on a regular basis as a putative class action and continue to target companies of all sizes, including small and mid-size ecommerce businesses,” said a filing posted Friday in docket 02-278. For those businesses, “the costs of engaging a lawyer to fight the meritless claims are exceptionally painful -- often representing the difference between taking home a paycheck or hiring a new employee.”
