FCC Rejects Mercury Pursuit of Waiver for RDOF Defaults

The FCC Wireline Bureau Tuesday rejected a petition by Mercury Broadband seeking a waiver of Rural Deployment Opportunity Fund rules. Mercury said in May (see 2505200063) a potential $25.1 million in fines for the surrender of multiple RDOF census block groups was "neither reasonable nor proportionate.”

Mercury’s decision to bid on areas, win support and then default “has potentially delayed the deployment of broadband to tens of thousands of Americans living in high-cost areas,” the bureau said. “Mercury has not established special circumstances that warrant granting the waiver.” The areas covered by the defaults are in parts of Kansas, Illinois, Indiana, Michigan, Missouri and Ohio. “
