“As an initial matter, Luminys did not make any false statements or representations when it certified the accuracy of its authorization application,” said a filing in docket 25-85. “The factual record clearly establishes the open and transparent manner in which Luminys has submitted information” to the FCC and “engaged with the Bureaus at each step throughout the process.”
Luminys raised concerns about the agency’s “misreading and broad misapplication of the Covered List requirements through the proposed revocation," saying that it was “in direct contravention of Congress’s intended goal to address national security risks related to specific equipment and services that are provided by specific entities.” Neither device for which Luminys obtained authorization, cited by the FCC, “was designed, developed, or manufactured in any way by ‘Dahua Technology Company’ or any other entity identified on the Covered List,” the company said.
