NW Spectrum Asks FCC to Eliminate 'Exploited' 2.5 GHz Exception

NW Spectrum asked the FCC to delete an exception in its Part 27 rules allowing the use of higher power levels in the 2.5 GHz band. “The Exception is no longer needed to incent deployment and competition in the 2.5 GHz band, and it is being abused by T-Mobile to the detriment of smaller wireless competitors in the 2.5 GHz band that are not working with T-Mobile,” said a filing posted Thursday in docket 25-133.

“The Exception was designed 20 years ago when viable commercial service in the 2.5 GHz band was not widespread, and the Commission was trying to incent the expeditious buildout of wireless services and competition,” the company said. The exception “is now being exploited by T-Mobile to block competition in the band.” Few of the 65 active commenters in the 2003-05 2.5 GHz proceeding still have rights in the band, the filing said. “Only one licensee, T-Mobile, holds 92% of the 2.5 GHz spectrum across the nation.”
