CIT Codifies Settlement in Suits on AD Review on Indian Steel Flanges

The U.S. and Indian exporters led by Kisaan Die Tech Private Limited on Sept. 30 reached a settlement in pair of cases on the 2018-19 review of the antidumping duty order on stainless steel flanges from India (Kisaan Die Tech Private Limited v. United States, CIT Consol. # 21-00512).

Kisaan will receive a 4.13% AD rate; exporter Echjay Forgings Private Limited, 1.7%; exporter Bebitz Flanges Works Private Limited, 74.3%; and the non-individually selected respondents, 5.2%. Judge Timothy Stanceu granted the judgment by stipulation.

The Commerce Department initially selected only one respondent in the review. In December, the trade court ruled against Commerce's use of a 145.24% adverse facts available rate on the lone respondent in setting the rates for 15 non-individually examined companies (see 2312110043). The parties said that after the decision, they reached an agreement on how to resolve the case (see 2405240071).
