Turkey Pipe AD/CVD Orders: Commerce Set to Recognize Borusan Mannesmann's Name Change

The Commerce Department looks set to recognize a Turkish company’s name change for the purposes of the antidumping and countervailing duty orders on circular welded carbon steel standard pipe and tube products (standard pipe), welded line pipe (WLP), certain oil tubular goods (OCTG), and large diameter welded pipe (LDWP) from Turkey (A-489-501/C-489-502, A-489-822/C-489-823, A-489-816/C-489-817, A-489-833/C-489-834). In the preliminary results of the AD and CVD changed circumstances reviews, the agency preliminarily found Borusan Birleşik Boru Fabrikalari Sanayi ve Ticaret A.S. (Borusan Boru) is the successor-in-interest to Borusan Mannesmann Boru Sanayi ve Ticaret A.S. (BMB).

Commerce preliminarily found Borusan Boru operates as materially the same business entity as BMB with respect to the production and sale of subject merchandise. Borusan Boru terminated its partnership with Salzgitter Mannesmann GmbH in 2023, and that was part of the reason for the name change. Commerce said Borusan Boru reported that the only change to its board of directors was to replace the Salzgitter-appointed directors. With regard to the CVD order, Commerce said there was no evidence of significant changes between BMB and successor in interest in Borusan Boru’s "operations, ownership or corporate or legal structure during the look back period which could have impacted the successor in interest company’s subsidy levels."

The company requested that Commerce assign it the cash deposit rates currently applicable to BMB pursuant to the standard pipe AD and CVD orders, welded line pipe AD and CVD orders, and the OCTG CVD order; and continue to exclude it from OCTG AD order and LDWP AD and CVD orders.

If Commerce confirms its findings in the final results of each changed circumstances review, Borusan Boru will inherit the AD rate assigned to BMB, i.e., 5.27%, and zero percent under the welded line pipe AD order; and the CVD rate under the standard pipe CVD order of 0.83%, the 0.78% rate under the welded line pipe CVD order, and the 0.38% (de minimis) rate under the OCTG CVD order.
