CIT Consolidates 4 Cases Challenging CVD Review of Chinese Wood Flooring
The Court of International Trade in a Sept. 20 order consolidated four cases contesting the Commerce Department's final results in the ninth administrative review of the countervailing duty order on multilayered wood flooring from China. The four cases were brought by lead plaintiffs Zhejiang Dadongwu Greenhome Wood, Evolutions Flooring, Baroque Timber Industries (Zhongshan) Co. and Fine Furniture (Shanghai). The cases were consolidated under the lead action brought by Baroque Timber.

In its complaint, Baroque said Commerce improperly used weighted averages of U.N. Comtrade data instead of International Tropical Timber Organization data in its valuation of plywood and face and back veneers for its less than adequate remuneration benefit calculation. Baroque also argued Commerce should have used the company's reported freight costs instead of an average of area costs. Finally, Baroque said Commerce illegally considered all of Baroque's suppliers to be Chinese government entities and thus improperly countervailed all input purchases (Baroque Timber Industries v. U.S., CIT #22-00210).
