Thailand Circular Welded Pipe: Amended Final Results of 2 AD Admin Reviews

The Commerce Department is amending the final results of two separate antidumping duty administrative reviews on circular welded carbon steel pipes and tubes (pipes and tubes) from Thailand (A-549-502) to align AD rates assigned to Pacific Pipe Public Co. Ltd., Saha Thai Steel Pipe (Public) Co., Ltd., and Thai Premium Pipe Co. Ltd., in one review, and Saha Thai in the other review, with the results of two court cases challenging those final results.

In the final results of the first review, covering the period March 1, 2016, through Feb. 28, 2017, Commerce assigned Pacific Pipe a 30.61% dumping margin, Saha Thai a 28% dumping margin and Thai Premium, 30.98%.

The amendment for this review reflects a change in calculation method and results in Pacific Pipe receiving a dumping margin of 7.38%, Saha Thai a zero percent dumping margin and Thai Premium, 5.23%, aligning Commerce's results with those determined in the court case.

In the final results of the second review, covering the period March 1, 2017, through Feb. 28, 2018, Commerce assigned Saha Thai a 5.15% dumping margin.

The amendment for this review reflects a change in calculation method and results in Saha Thai receiving a dumping margin of zero percent, aligning Commerce's results with those determined in the court case.

The amended rates in each review, however, will not affect the current cash deposit rates assigned in the most recent final results of the AD administrative review of the subject merchandise (see 2112070049). And Commerce will not issue revised cash deposit instructions to CBP.

The first notice also said Commerce remains, at this time, enjoined by court order from liquidating entries "that: were produced and exported by Pacific Pipe, Saha Thai, and Thai Premium, and were entered, or withdrawn from warehouse, for consumption during the period March 1, 2016, through February 28, 2017. These entries will remain enjoined unless the injunction is lifted by the court, pursuant to the terms of the injunction, during the pendency of any appeals process."

In the second notice, Commerce said that the "time for appeals has expired. Because Saha Thai’s weighted-average dumping margin is zero or de minimis within the meaning of 19 CFR 351.106(c)(1), we intend to instruct CBP to liquidate the appropriate entries without regard to antidumping duties."
