CIT Finds Commerce Properly Explained Sale Exclusion from Home Market Sales in AD Case

The Court of International Trade sustained remand results in an antidumping investigation over whether a sale of steel flanges from an Indian exporter should be excluded from the home market sales database when determining the antidumping duty margin.

In a May 13 opinion, Judge Gary Katzmann determined that Commerce adequately reached its conclusion that the shipment in question was meant for export. The exporter, Chandan, had been assigned a 19.16% antidumping duty margin after Commerce used a different market to determine the normal value of steel flange sales.
