Dish's petition for writ of certiorari (SCOTUS docket 20-743) said the 7th Circuit decision created "a classic circuit split," with different rulings on similar vicarious liability cases from the 4th and 9th circuits, and is "expos[ing] companies to essentially limitless vicarious liability under the telemarketing laws." It said the 7th Circuit finding Dish vicariously liable for outside telemarketing agency actions also contradicts an FCC vicarious liability declaratory ruling.
