Oct. 14 CBP Bulletin Proposes to Revoke Rulings on Windshield Cleaner, Foil Print Fabric
In the Oct. 14 Customs Bulletin (Vol. 54, No. 40), CBP published notices that propose to revoke rulings and similar treatment for windshield cleaning devices and foil print fabric.

Comments on Proposals Due Nov. 13
CBP said consideration will be given to any written comments received by Nov. 13 before taking these actions. In addition, any party that has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations subsequent to the effective date of the final decision in this notice.)
Proposals
CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke any treatment it has previously accorded to substantially identical transactions.
Windshield Cleaning Device

Reason: The products contribute to the effectiveness and affects the operations of motor vehicles of headings 8701 to 8705 by enabling the removal of ice or snow from their windows, lights, and other parts for better visibility while driving, CBP said. “The item appears identifiably suitable for use solely or principally for a motor vehicle of headings 8701 to 8705. Moreover, the item is not excluded from classification as an accessory to a motor vehicle of headings 8701 to 8705, and it is not further specified elsewhere in the Nomenclature. |

Current: 6004.10.0085, 12.3%, “Knitted or crocheted fabrics of a width exceeding 30 cm, containing by weight 5 percent or more of elastomeric yarn or rubber thread, other than those of heading 6001: containing by weight 5 percent or more of elastomeric yarn but not containing rubber thread, other.” |
Proposed: 5903.90.2500, 7.5%, “Textile fabrics impregnated, coated, covered or laminated with plastics, other than those of heading 5902: Other: Of man-made fibers: Other: Other.” |
Reason: The shiny metallic coating (of .25mm plastic dots) does not create a pattern or design but instead, consists of features consistent with terms of heading 5903, CBP said. CBP also found the merchandise to be eligible for preferential tariff treatment under the U.S.-Korea Free Trade Agreement. |
