Congress' explicit desire that cable rates be set by competition, not regulation. So read an FCC brief Wednesday with the 1st U.S. Circuit Court of Appeals (in Pacer, docket 19-2282). The LEC test's statutory text and legislative history back the idea it doesn't impose a facilities-based restriction on LECs and their affiliates, the FCC said. MDTC didn't comment.
