"It is ironic that Petitioners rail about STI flouting the rules while they blithely ignore the comment deadlines," said the opposition posted Tuesday in docket 17-126. The opposition said the petition also failed to make sufficient specific allegations of fact and was "frivolous at best," a "last-minute attempt to introduce unwarranted delay into a proceeding that otherwise qualifies for the FCC’s streamlined application process." The petitioners "argue that STI per-minute charges for intrastate rates violate per-call or flat-rate charge rules, ignoring the position of a majority of the FCC and of the U.S. Court of Appeals for the DC Circuit, which held that at this juncture the FCC cannot dictate intrastate rate practices for inmate calling service ('ICS') providers," said Securus and SCRS. They said STI fully complied with applicable regulations since they took effect in 2016, and they disputed other petitioner allegations.
