AD/CV: Indonesia, Vietnam Polyethylene Retail Carrier Bags
The International Trade Administration has issued a fact sheet announcing its affirmative final determinations in the antidumping duty investigations of polyethylene retail carrier bags from Indonesia and Vietnam, and in the countervailing duty investigation for Vietnam.

The ITA will instruct U.S. Customs and Border Protection to collect a cash deposit or bond on imports of plastic bags based on the final AD rates below. Cash deposits of CV duties on imports of plastic bags from Vietnam will not be required unless the International Trade Commission makes a final affirmative injury determination.
Final AD Rates Range from 69.64% to 85.17% for Indonesia
The ITA has found that producers/exporters from Indonesia have sold plastic bags in the U.S. at 69.64% to 85.17% less than normal value.
Mandatory Indonesian respondents P.T. Sido Bangun Indonesia and P.T. Super Exim Sari Ltd./P.T. Super Makmur will receive final AD duty rates of 85.17% and 69.64%, respectively. All other producers/exporters from Indonesia will receive a final AD duty rate of 69.64%.
Final AD Rates Range from 52.30% to 76.11% for Vietnam
The ITA has found that producers/exporters from Vietnam have sold plastic bags in the U.S. at 52.30% to 76.11% less than normal value.
Sixteen Vietnamese producer/exporters qualified for a separate rate of 52.30%. All other Vietnamese producers/exporters of plastic bags will receive the Vietnam-wide entity rate of 76.11%, including the Vietnamese mandatory respondents, Advance Polybag Co., Ltd. and Fotai Vietnam Enterprise Corporation.
Final CV Rates Range from De Minimis to 52.56% for Vietnam
The ITA has also determined that Vietnamese producers/exporters have received net countervailable subsidies ranging from less than 0.44% (de minimis) to 52.56%.
The three mandatory respondents, Chin Sheng Company, Ltd., Fotai Vietnam Enterprise Corp., and Advance Polybag, will receive final CV duty rates of 0.44% (de minimis), 5.28%, and 52.56%, respectively. All other producers/exporters from Vietnam will receive a final CV duty rate of 5.28%.
ITC to Issue Final Injury Determination in May 2010
The ITC is scheduled to issue its final injury determinations on or about May 10, 2010. If the ITC makes affirmative determinations that imports of plastic bags from Indonesia and Vietnam materially injure, or threaten material injury to, the domestic industry, the ITA will issue AD and CV duty orders. If the ITC makes negative injury determinations, the investigations will be terminated.
