1The ITA states that the cash deposit requirements will be effective retroactively on any entries made on or after August 17, 2009, the date of publication of the final results; therefore, the ITA is required to grant a refund for any overcollection of duties if the importer makes such a request.

3The China-wide entity includes Dongguan Bon Ten Furniture Co., Ltd4.; Dream Rooms Furniture (Shanghai) Co., Ltd.; Hamilton & Spill, Ltd.; Dongguan Qingxi Xinyi Craft Furniture Factory (Joyce Art Factory); Tianjin Sande Fairwood Furniture Co. Ltd.; and Yida Co. Ltd., Yitai Worldwide Ltd., Yili Co., Ltd., and Yetbuild Co., Ltd. (collectively, Yida).

4The ITA notes that its determination concerning Bon Ten covers the period August 1, 2007, through December 31, 2007, not the entire period of review.

(a) The ITA continues to find AD duty rates of zero for subject merchandise exported by Golden Well and produced by Zhangzhou XYM, and for subject merchandise exported and produced by Dongguan Sunshine; therefore, no cash deposit is required for these entries;

(b) For previously investigated or reviewed China and non-China exporters not listed above that have separate rates, the AD duty cash deposit rate will continue to be the exporter-specific rate published for the most recent period;

(c) For all China exporters of subject merchandise which have not been found to be entitled to a separate rate, the AD duty cash deposit rate will be the China-wide entity rate of 216.01%; and

(d) For all non-China exporters of subject merchandise which have not received their own rate, the AD duty cash deposit rate will be the rate applicable to the China exporters that supplied that non-China exporter.

Assessment Instructions for the Review Period (01/01/07 - 12/31/07)

The ITA intends to issue appropriate assessment instructions directly to U.S. Customs and Border Protection 15 days after October 29, 2009. Where appropriate, the ITA calculated importer- or customer-specific duty assessment rates, and a per-unit rate for each importer or customer.

Where an importer- or customer-specific assessment rate is de minimis, the ITA will instruct CBP to assess that importer or customer's entries of subject merchandise without regard to AD duties.

(See ITA notice for more information, including the scope of the order, etc.
