AD: Thailand Certain Frozen Warmwater Shrimp

The International Trade Administration has issued the final results of an antidumping duty changed circumstances review of certain frozen warmwater shrimp from Thailand.

The ITA initiated this review to determine whether it is appropriate to exclude two companies from the subject AD duty order, Phatthana Frozen Food Co., Ltd. (PFF) and Sea Wealth Frozen Food Co., Ltd., both of which became operational after the AD investigation.

(In its Section 129 implementation of this order, the ITA found a de minimis AD duty rate for the Rubicon Group, which includes nine companies, and therefore the nine companies that comprised the Rubicon Group were excluded from the AD duty order.

PFF and Sea Wealth were not originally included in the list of nine companies comprising the Rubicon Group as they became operational after the AD investigation; however, the ITA has treated them as part of the Rubicon Group in subsequent segments of the proceeding.)

PFF and Sea Wealth Excluded from AD Order as Part of Rubicon Group

For these final results, the ITA finds that the Rubicon Group, inclusive of PFF and Sea Wealth, is the successor-in-interest to the Rubicon Group as it operated during the AD investigation. Accordingly, the ITA is excluding PFF and Sea Wealth from the AD duty order on certain frozen warmwater shrimp from Thailand, effective as of January 16, 2009.

(The ITA notes that this exclusion applies to merchandise produced by any Rubicon Group member and exported by PFF or Sea Wealth, as well as to merchandise produced by PFF or Sea Wealth and exported by any other Rubicon Group member.)

CBP Liquidation, Refund Instructions for Entries On/After Jan. 16, 2009

The ITA will instruct U.S. Customs and Border Protection to terminate the suspension of liquidation for all shipments of frozen warmwater shrimp produced and exported by PFF or Sea Wealth, either singly or in combination with any other Rubicon Group member, with a time of entry on or after January 16, 2009.

Further, the ITA will instruct CBP to liquidate without regard to AD duties, and to release any bonds and refund any cash deposits, on entries of frozen warmwater shrimp produced and exported by these entities, with a time of entry on or after January 16, 2009.
