AD: Chile Individually Quick Frozen Red Raspberries

The International Trade Administration has issued its final results of the antidumping duty administrative review of individually quick frozen red raspberries from Chile for the period of July 1, 2006 through June 30, 2007.

The ITA's review covers sales of individually quick frozen red raspberries with respect to Sociedad Agroindustrial Valle Frio Ltda./Agricola Framparque.

AD Order Was Revoked Effective July 9, 2007

However, the order was revoked for Valle Frio/Framparque and all but two companies, effective for entries of subject merchandise with a time of entry on or after July 9, 2007. (Two of the revoked companies have a different effective date of revocation.)

As a result, there will be no prospective AD cash deposit requirement for Valle Frio/Framparque.

Assessment Instructions for the Review Period (07/01/06 - 06/30/07)

The ITA intends to issue appropriate assessment instructions for the July 1, 2006 through June 30, 2007 review period to CBP 15 days after December 8, 2008.

The ITA will also instruct CBP to liquidate without regard to AD duties any entries for which the assessment rate is de minimis. (Valley Frio's final AD margin is de minimis under this administrative review.)

The ITA adds that for entries of subject merchandise during the review period produced by the respondent for which it did not know its merchandise was destined for the U.S., the ITA will instruct CBP to liquidate unreviewed entries at the all-others rate of 6.33% if there is no rate for the intermediate company(ies) involved in the transaction.
