AD: Korea Certain Circular Welded Steel Line Pipe

The International Trade Administration has made a preliminary affirmative antidumping duty determination that certain circular welded carbon quality steel line pipe from Korea is being, or is likely to be, sold in the U.S. at less than fair value.

Suspension of liquidation (except SeAH). The ITA is directing U.S. Customs and Border Protection to suspend liquidation of all entries of subject welded line pipe from Korea, with the exception of those produced and exported by SeAH Steel Corporation, with a time of entry on or after November 6, 2008.

Because the AD duty margin for SeAH is de minimis, the ITA will not instruct CBP to suspend liquidation of subject merchandise produced and exported by SeAH.

AD cash deposit or bond. The ITA will also instruct CBP to require a cash deposit or the posting of a bond at the AD rates listed below, for entries of subject merchandise from Korea with a time of entry on or after November 6, 2008:

(a) The ITA has determined a preliminary AD duty rate of zero for SeAH; therefore, no cash deposit is required.

(The ITA notes that if the exporter is not a firm identified in this investigation, but the producer is, the rate will be the rate established for the producer of the subject merchandise.)

ITA Preliminarily Determines Targeted Dumping for Certain SeAH Sales

According to the ITA, a petitioner in this investigation submitted an allegation of targeted dumping with respect to SeAH, asserting that there are patterns of constructed export prices (CEPs) for comparable merchandise that differ significantly among purchasers and regions.

The ITA preliminarily determines that there is a pattern of CEPs for comparable merchandise that differ significantly among customers and regions for SeAH. Therefore, the ITA has applied the average-to-transaction methodology to the targeted sales by SeAH. For all other U.S. sales by SeAH (i.e., non-targeted), the ITA has applied the average-to-average methodology for purposes of determining SeAH's overall weighted-average dumping margin.

Final Determination Postponed, Provisional Measures Extended

The ITA is also postponing the final determination and extending provisional measures from a four-month period to not more than six months. Accordingly, the ITA will make its final determination not later than 135 days after November 6, 2008.
