AD : Korea Light-Walled Rectangular Pipe and Tube

The International Trade Administration has issued an AD duty order on light-walled rectangular pipe and tube (LWRP) from Korea.

The ITA has also determined that it made a ministerial error in its calculation of the final AD duty rate for merchandise produced by Nexteel and exported by Hyundai Corporation or SK Networks ("Nexteel"), which also affects the AD duty rates for SeAH Steel Corporation, Ltd., and the 'all-others' rate.

Nexteel's Rate Remains De Minimis, SeAH and 'All Others' Rates Amended

As a result of the ITA's correction, the final AD rate for Nexteel has changed from 1.30% to 0.92%. This correction does not affect Nexteel's exclusion from the AD duty order, as its rate remains de minimis.

However, the all-others rate and the rate for SeAH have changed from 15.98% to 15.79%.

AD Suspension of Liquidation Instructions

The ITA will instruct CBP to continue the suspension of liquidation for entries of subject merchandise with a time of entry on or after January 31, 2008 (the date of publication of the preliminary determination), for all producers/exporters other than Nexteel.

(Liquidation is not suspended for Nexteel as it is excluded from the AD order.)

AD Cash Deposit Instructions

CBP will require, at the same time as importers would normally deposit estimated duties on subject merchandise, a cash deposit equal to the following AD margins for entries on or after August 4, 20081 (certain AD rates have changed since the final determination):
