AD: Italy Certain Pasta
The International Trade Administration has issued the preliminary results of its self-initiated antidumping duty changed circumstances review of certain pasta from Italy.

The ITA is conducting this AD duty changed circumstances review with respect to Pasta Lensi S.r.l. (Lensi), a producer/exporter of pasta from Italy, and American Italian Pasta Company (AIPC), Lensi's corporate parent and importer of subject merchandise produced by Lensi, due to the voluntary disclosure of certain shipment information by these companies.
ITA Provisionally Reinstates AD Duty Order for Lensi
The ITA preliminarily determines that Lensi made sales at less than normal value during
the 2002-2003 review period, and that, consequently, it no longer qualifies for revocation based upon three consecutive reviews resulting in de minimis margins.
As a result, the AD duty order on certain pasta from Italy is being provisionally reinstated for subject merchandise produced and exported by Lensi. (See ITT's Online Archives or 02/10/05 news, 05021025, for BP summary of the revocation of the order for Lensi.)
Suspension of Liquidation and AD Cash Deposit Requirement Imposed
The ITA will instruct U.S. Customs and Border Protection to suspend liquidation and require an AD cash deposit of 45.59% for all entries of subject merchandise produced and exported by Lensi with a time of entry on or after February 22, 2008.
The ITA states it will issue its final results of review within 270 days of November 9, 2007.
