AD: Korea Light-Walled Rectangular Pipe and Tube

The International Trade Administration has made a preliminary affirmative antidumping duty determination that light-walled rectangular pipe and tube (LWR) from Korea is being, or is likely to be, sold in the U.S. at less than fair value.

Suspension of liquidation (except Nexteel). The ITA is directing U.S. Customs and Border Protection to suspend liquidation of all entries of LWR from Korea, with the exception of those produced and exported by Nexteel Co., Ltd., or produced by Nexteel and exported by either of the two companies named in its questionnaire responses1, with a time of entry on or after January 31, 2008.

Because the preliminary AD duty rate for Nexteel is de minimis, the ITA will instruct CBP not to suspend liquidation of merchandise produced and exported by Nexteel Co., Ltd., or produced by Nexteel and exported by either of the two companies named in its questionnaire responses1.

AD cash deposit or bond (except Nexteel). The ITA will also instruct CBP to require a cash deposit or the posting of a bond at the AD rates listed below, for entries of subject merchandise from Korea (except Nexteel as described above) with a time of entry on or after January 31, 2008 for the following exporters/producers:

(a) The ITA has calculated a preliminary de minimis AD duty rate of 1.30% for Nexteel. As this is a preliminary determination, such a rate preliminarily excludes Nexteel (and either of the two exporters named in its questionnaire responses) from the suspension of liquidation/cash deposit/bond requirements;

(The ITA notes that if the exporter is not a firm identified in this investigation, but the producer is, the rate will be the rate established for the producer of the subject merchandise.)

Postponement of Final AD Duty Determination

In addition, the ITA states that it is postponing its final AD duty determination for LWR from Korea until not later than 135 days after January 31, 2008, and suspension of liquidation will be extended accordingly.

1ITA sources confirm that the names of two exporters named in Nexteel's questionnaire responses are currently business proprietary; however, the names of these exporters are expected to be released with Customs' instructions. It should be noted that instructions may differ for each producer/exporter combination when they are released.
