WTNH-TV sought waiver saying market had changed and it, rather than N.Y. affiliate, now was dominant force in lower Conn. Commission agreed, saying WABC-TV’s “significantly viewed exception” to network nonduplication rules no longer prevailed and therefore Comcast should black out network programming on N.Y. affiliate shown in Comcast system’s Conn. region. WTNH-TV sought same rights in case against WWOR-TV Secaucus, N.J. Commission held that WWOR-TV also no longer qualified for “significantly viewed” status.
