thus would advance competition. “Competition could work far better if ILECs had more incentive to develop their wholesale markets and to view CLECs as good business partners, rather than merely as a regulatory burden,” Mpower said. Since Telecom Act’s Sec. 252 includes “pick & choose” requirement, Mpower petitioned for both forbearance and rulemaking. Pick & choose gives CLECs opportunity to opt into individual sections of contracts that ILECs sign with other CLECs. Mpower also urged federal enforcement of FLEX contracts, which it said would “look much like typical wholesale contracts for long distance services or typical retail-type contracts for wireless services.” Similarly situated CLECs could opt into them but not on pick & choose basis, company said.
