SBC testimony either were known by RBOC before submission or should have been discovered “as part of an ordinary, prudent prefiling review by the company.” Incident illustrated why Commission should adhere to earlier precedent that required Sec. 271 applicants to show through commercial experience or independent 3rd party testing that “Operation Support Systems work as advertised,” CompTel said. SBC said it alerted regulators that it inappropriately described “manner in which our highly technical and complex computer systems provide loop qualification information to competitors interested in providing DSL service.” Carrier said it alerted FCC, Dept. of Justice and state commissions in early April and since has “corrected the record and improved our loop qualification process so that it now exceeds FCC requirements.”
