Harmonized Tariff Schedule

The Harmonized Tariff Schedule (HTS) provide classification provisions and duty rates for almost every item that exists. It is a system of classifying and taxing all goods imported into the United States. The HTS is based on the international Harmonized System, which is a global standard for naming and describing trade products, and consists of a hierarchical structure that assigns a specific code and rate to each type of merchandise for duty, quota, and statistical purposes. The HTS was made effective on January 1, 1989, replacing the former Tariff Schedules of the United States. It is maintained by the U.S. International Trade Commission, but CBP is responsible for interpreting and enforcing the HTS.

Importer Asks for CIT Update in Section 232 Exclusion Case

Counsel for steel importer California Steel Industries requested a status conference regarding a pending motion from the Commerce Department for voluntary remand in a Section 232 steel and aluminum tariff exclusion case. Since the last brief in the proceeding was filed over a year ago, on June 9, 2022, California Steel called for the conference regarding the "next steps to resolve" the company's claims while being "mindful of [Judge M. Miller Baker's] busy schedule" (California Steel Industries v. U.S., CIT # 21-00015).

Furniture Importer Files Suit at CIT Over Section 301 Product Exclusions

CBP incorrectly denied protests seeking retroactive refunds of Section 301 duties for entries of furniture parts and boxes imported from China, importer Store Supply Warehouse said in an Aug. 4 complaint at the Court of International Trade. The protested items consisted of nine entries of hardware racks, three entries of jewelry boxes and 10 entries of showcase parts imported through the Port of Savannah (Store Supply Warehouse v. U.S., CIT # 23-00035).

Commerce Sticks With Benchmark Picks for Aluminum Plate, Land in Chinese CVD Case

The Commerce Department stuck by its benchmark picks for the land program and the aluminum plate, sheet and strip program in a suit on the 2016-17 administrative review of the countervailing duty order on aluminum foil from China. Submitting its remand results to the Court of International Trade on Aug. 4, Commerce said Trade Data Monitor data on Harmonized System subheading 7606.12 was properly used as the benchmark for the aluminum plate program, and that a 2010 Coldwell Banker Richard Ellis (CBRE) report on Thailand was the proper land benchmark (Jiangsu Zhongji Lamination Materials Co. v. U.S., CIT # 21-00133).
