Harmonized Tariff Schedule

The Harmonized Tariff Schedule (HTS) provide classification provisions and duty rates for almost every item that exists. It is a system of classifying and taxing all goods imported into the United States. The HTS is based on the international Harmonized System, which is a global standard for naming and describing trade products, and consists of a hierarchical structure that assigns a specific code and rate to each type of merchandise for duty, quota, and statistical purposes. The HTS was made effective on January 1, 1989, replacing the former Tariff Schedules of the United States. It is maintained by the U.S. International Trade Commission, but CBP is responsible for interpreting and enforcing the HTS.

UK Court of Appeal Says Build-a-Bear's Accessories Subject to 4.7% Duty Rate

The U.K. Court of Appeal in a June 21 judgment dismissed a case from Build-a-Bear Workshop over the classification of accessories for its stuffed bear imports. Build-a-Bear originally filed the case to avoid the 4.7% duty rate for the accessories, which included clothing and wigs, footwear, plastic and textile hearts and animal accessories, and seek duty-free treatment. In March, the Upper Tribunal Tax and Chancery sided with Her Majesty's Revenue and Customs agency that the accessories should be classified as "other toys" (see 2104010047).

USTR Needs 60 More Days to Meet Section 301 Remand Order, DOJ Says

With less than two weeks to spare before the June 30 deadline for the Office of the U.S. Trade Representative to file its remand results in the Section 301 litigation, the agency needs a 60-day extension to Aug. 29 due to the volume of work involved, the agency’s limited staff resources and other projects that are compounding its workload, DOJ said June 17 at the Court of International Trade. Akin Gump lawyers for test-case plaintiffs HMTX Industries and Jasco Products oppose the motion and soon will file a response, DOJ said. Matthew Nicely, Akin Gump’s lead attorney, declined to comment June 17.
